The following General Terms and Conditions (“GTC”) apply to all deliveries and all your purchase orders placed at the ACRIBIA Online-Shop founded by Elli Hoppe, Hehlinger Str. 40, 38446 Wolfsburg, Germany. All contracts concluded between you as a customer (“you”) and Elli Hoppe as the operator and founder of the online shop named ACRIBIA (www.acribiafashion.com and www.acribia.shop)

Within the framework of the order process, you acknowledge the GTC in the version valid at the time of placing your order. Deviating or additional General Terms and Conditions of the Customer shall only apply insofar as Elli Hoppe has agreed to them in text form in individual cases.

These General Terms and Conditions apply to consumers. According to the statutory definition (§13 BGB), a consumer is any natural person who concludes a legal transaction for purposes which can predominantly neither be attributed to his commercial nor his self-employed professional activity.

The presentation of goods in our online shop does not yet include a binding offer to sell but a noncommittalrequest to order products from the ACRIBIA online shop.

The goods you have selected are first collected in a virtual shopping bag but not reserved for you and can be purchased by other customers in the meantime.
After providing your contact details, payment and shipping information, you make a binding purchase offer by clicking the “BUY NOW” button.
Before that, you can check your data and change them if necessary and correct input errors. Your binding order can only be dispatched if you have expressly accepted these GTC.
You make the offer to conclude a purchase contract as a customer by clicking on the button “BUY NOW”.
The receipt of your order will be confirmed immediately by an automated e-mail after sending your request; this does not yet represent an acceptance of the contract by ACRIBIA but is merely for your information.

After placing your order, you will receive an automatically generated e-mail, which is only a confirmation of receipt of your order. No contract is concluded yet with this e-mail.
A purchase contract for the goods is concluded only by the “order confirmation” e-mail sent manually by us (ACRIBIA).

We are entitled, but not obliged, to accept your contract offer within 14 calendar days of receipt. If your offer is not accepted within 14 calendar days, it will be rejected.

3) PRICES, SHIPPING COSTS & CUSTOMS FEES

The final prices stated on the product pages include the statutory VAT (value-added tax) valid for Germany and other price components.

All prices are exclusive of the respective shipping costs and any applicable customs fees, which are borne by the customer.
The prices for deliveries to countries of the European Union (“EU”) are stated in Euro (EUR). Any refunds shall also be made based on the payment initially made by you, without taking into account changing exchange rates.
The respective delivery cost to your country will be displayed during the checkout process. You can see shipping costs also under our “Shipping Policy”.

In the case of shipment to a non-EU country, additional taxes and costs (e.g. customs duties) may be incurred in connection with your order, which cannot be paid by us or invoiced by us but must be paid directly by you to the responsible customs or tax authorities. Please ask these authorities for details.

4) DELIVERY & RESERVATION OF OWNERSHIP

All of our garments are made to order, and shipping times will vary depending on the complexity and order quantity. At least your order will be ready for shipment within 14 working days and delivered by UPS, United Parcel Service, Inc. within approximately 3-5 business days.
Delivery times are approximate, and a delay in it does not include a possible claim for damages. All orders are delivered Monday to Friday and are not shipped and/or delivered on weekends or holidays.

After your order has been shipped from our atelier in Rome to the address you have specified in your order; you will receive an e-mail with a tracking number to track your package online.

We will always endeavour to deliver as quickly as possible. If an ordered product is not available, ACRIBIA may reject your purchase offer. In this case, we will immediately inform you and refund any consideration already paid.

The goods remain our property until the purchase price has been paid in full, even if they are in your possession.
In the event of seizure of the goods or other intervention by a third party, you are obliged to inform us immediately and to inform the third party of our retention of title.

We do not deliver to packing stations, P.O. Boxes or P.O. Boxes. All orders must be signed to confirm receipt.
The goods you have ordered will be delivered to the delivery address you specified during the ordering process. Note that there are delivery restrictions in our Shop regarding the countries we deliver to.

5) TERMS OF PAYMENT

We only accept the payment methods that are displayed to you when you place an order.
You can choose optionally from Credit Card payments with AMEX, VISA and MASTERCARD, payment by PAYPAL and TRANSFER ASAP.
When paying by bank transfer, the payment will be processed by SOFORT GmbH, Fußbergstraße 1, 82131 Gauting, Germany.

When paying by CREDIT CARD, the amount of the purchase price will be reserved on your Credit Card at the time of ordering. We will charge your Credit Card account when dispatching your order.

Your PayPal payment will be processed by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. The Terms and Conditions of the contracting parties shall apply. If you pay with PayPal, you will be redirected to the PayPal page at the checkout where you can log in and complete the payment process. Once the payment has been made, you will be redirected to ACRIBIA.

All transactions on this website are processed via STRIPE. This is a secure online payment portal where your payment details are encrypted in a secure host environment.
During transport, your order is insured by ACRIBIA until it is delivered. Upon delivery and signature, liability for the purchased items shall pass to you. If you are not the recipient yourself (e.g. in the case of a gift), then you accept the performance of the contract by ACRIBIA and the transfer of liability to the recipient.

6) DISCOUNTS & VOUCHERS

All payments are to be made to ACRIBIA/Elli Hoppe without deduction. As soon as we can freely dispose of the amount, the fee is deemed to have been made. Vouchers and discounts can only be credited before an order is completed. The value of coupons and discounts cannot be paid out, and promotional voucher codes are only valid for the specified period. All vouchers and discounts can be tied to specific products and have a minimum order value. The respective redemption conditions can always be found on the voucher itself or in the e-mail, including the discount code. Coupons and discounts that can be redeemed once expire in the event of a return.

7) EXCHANGE & RETURNS

All Acribia garments are made to order just for you. In any case, if you are not completely satisfied with your order, you have 14 calendar days (from the date of receipt) for returning your shipment.
With the return label provided, the return within Europe/Schengen is FREE of charge.

Please note: You will bear the immediate cost of returning the goods if you do not follow our returns procedure below.
We ask for your understanding that consignments returned to us freight collect cannot be accepted.

All returned item/s must be:
In its original conditions: unused, unworn, unwashed, undamaged and with all product labels and all accessories included.

All tags have to be still attached in the same place as originally sent.
All returns must be received/ proceeded within 14 days of delivery.

We do not have ready-to-wear stock items; therefore, we can‘t offer an exchange service. If you desire an article in another size or colour, you need to do a return and place a new order.

8) RIGHT OF WITHDRAWAL

If you are a consumer, that means every natural person who enters into a legal transaction which is not mainly induced by either his commercial or self-employed professional activity; you have a right of withdrawal subject to the following provisions.

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us of your decision to cancel this contract through a clear statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.
To meet the cancellation deadline, it is sufficient for you to send your communication regarding your right of withdrawal before the withdrawal period (14 calendar days from receipt) expires.

EFFECTS OF WITHDRAWAL

If you revoke this Agreement, all payments received from you by ELLI HOPPE VIA ACRIBIA, including delivery costs (but excluding any fees resulting from your choosing a different type of delivery from the cheapest standard delivery offered), will be refunded to you immediately within 14 days from the date on which we received the revoked goods.
This refund will be made using the same means of payment you used in the original transaction, unless otherwise expressly agreed and in no event will you be charged for this refund.

We may withhold reimbursement until we have received the goods back or until you supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods immediately and in any case within 14 calendar days at the latest from the day on which you notify ACRIBIA BY ELLI HOPPE of the revocation of this Agreement. The period shall be deemed to have been observed if you dispatch the goods before the expiry of the period of 14 calendar days.
The goods must be returned to ACRIBIA insured and traceable. You only have to pay for a possible loss in value of the goods if this loss in value is due to a handling of the products that are not necessary for testing their condition, properties and function.

End of withdrawal conditions

Please note:

The right of withdrawal does not apply to any delivery of products which are made to your specifications, which are clearly tailored to your personal needs or which are personalised (e.g. customised production), to any delivery of sealed goods which are not suitable for return of reasons of health protection or hygiene if their seals have been removed after delivery.

By following the instruction for the revocation process from our return policy, the shipment for you is free.
If you decide on a process or dispatch of your choice, you bear the direct costs of returning the goods yourself.

Please only return items that are new, unworn, undamaged, unwashed, in perfect condition and with all original ACRIBIA labels attached.

9) WARRANTY

According to the legal regulations, you have the right to a warranty for defects in the purchased goods. The guarantee takes place according to the legal regulations (§§ 437ff BGB).
Please note that our products are not pre-produced but made to order just for you. All products are limited to a small number of pieces and artisanally produced. Therefore, there may be minor,
technically unavoidable deviations in the colour, width, shape, equipment or design of patterns, which in this case do not constitute a defect. You are free to prove that the deviations mentioned are significant for you. All warranty claims expire if you change the goods or intervene in the goods in some way. Please also consider the washing and care instructions on the product labels. If care instructions have not been followed correctly or changes have been made to the products, there is no warranty.

10) LIABILITY

ACRIBIA by Elli Hoppe shall be liable for damages in accordance with the statutory provisions unless otherwise specified below.
In the event of breaches of duty – for whatever legal reason – Elli Hoppe (ACRIBIA) shall be responsible for intent and gross negligence within the scope of its liability for culpa in contrahendo.
Subject to a milder standard of liability following statutory provisions (e.g. for care in its affairs), Elli Hoppe (ACRIBIA) shall only be liable in the event of ordinary negligence:

1. for damages resulting from injury to life, body or health and
2. for damages arising from the not inconsiderable breach of an essential contractual obligation (obligation the fulfilment of which is necessary for the proper performance of the contract and the observance of which the contractual partner regularly relies on and may rely on); in this case, however, liability is limited to compensation for the foreseeable, typically occurring damage.
The above limitations of liability shall also apply to third parties as well as to breaches of duty by or for the benefit of persons whose fault Elli Hoppe (ACRIBIA) is responsible for in accordance with statutory provisions.

11) CUSTOMER ACCOUNT & REGISTRATION

To make it easier to use our online shop, you have the option of registering for a customer account.
Your order data is saved in your account or our customer database. This makes it easier for you as a customer to place additional orders and returns.

For registration, we need the following data from you: surname, first name, address, a possibly different delivery address and an email address.
Your email address is automatically your username. You must also create a password for your user account. You can change the username and password at any time after logging into your account.
As a customer, you are responsible for the misuse of the access code and password. The information and personal data that you provide to us will be processed, taking into account and following the applicable data protection declaration.
You can view ACRIBIA‘s data protection declaration at any time in the online shop under “Privacy Policy”. After your registration, you will receive a confirmation message by email that your customer account has been set up for you.
You have the option to delete your customer account at any time or use and place orders the ACRIBIA online shop as a guest.

Please note that we reserve the right to cancel orders, refuse registration and delete the customer account if necessary and inform the responsible authorities if we have reason to believe that the information provided is incorrect or fraudulent orders have been placed by you.

12) DISPUTE RESOLUTION FOR CONSUMERS

The EU Commission has created an Internet platform for the online settlement of disputes. The platform serves as a contact point for out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. However, we (Elli Hoppe, ACRIBIA) are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

13) FINAL PROVISIONS

These General Terms and Conditions and the contractual relationship with you shall be governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
If the customer places an order via our webshop, only the German version of these terms and conditions shall apply.
Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. Instead of the invalid provision, the relevant statutory provisions shall apply.

This refund will be made using the same means of payment you used in the original transaction, unless otherwise expressly agreed and in no event will you be charged for this refund.

We may withhold reimbursement until we have received the goods back or until you supplied evidence of having sent back the goods, whichever is the earliest.
You must return or hand over the goods immediately and in any case within 14 calendar days at the latest from the day on which you notify ACRIBIA BY ELLI HOPPE of the revocation of this Agreement. The period shall be deemed to have been observed if you dispatch the goods before the expiry of the period of 14 calendar days.
The goods must be returned to ACRIBIA insured and traceable. You only have to pay for a possible loss in value of the goods if this loss in value is due to a handling of the products that are not necessary for testing their condition, properties and function.

End of withdrawal conditions

Please note:

The right of withdrawal does not apply to any delivery of products which are made to your specifications, which are clearly tailored to your personal needs or which are personalised (e.g. customised production), to any delivery of sealed goods which are not suitable for return of reasons of health protection or hygiene if their seals have been removed after delivery.

By following the instruction for the revocation process from our return policy, the shipment for you is free.
If you decide on a process or dispatch of your choice, you bear the direct costs of returning the goods yourself.

Please only return items that are new, unworn, undamaged, unwashed, in perfect condition and with all original ACRIBIA labels attached.

9) WARRANTY

According to the legal regulations, you have the right to a warranty for defects in the purchased goods. The guarantee takes place according to the legal regulations (§§ 437ff BGB).
Please note that our products are not pre-produced but made to order just for you. All products are limited to a small number of pieces and artisanally produced. Therefore, there may be minor,
technically unavoidable deviations in the colour, width, shape, equipment or design of patterns, which in this case do not constitute a defect. You are free to prove that the deviations mentioned are significant for you. All warranty claims expire if you change the goods or intervene in the goods in some way. Please also consider the washing and care instructions on the product labels. If care instructions have not been followed correctly or changes have been made to the products, there is no warranty.

10) LIABILITY

ACRIBIA by Elli Hoppe shall be liable for damages in accordance with the statutory provisions unless otherwise specified below.
In the event of breaches of duty – for whatever legal reason – Elli Hoppe (ACRIBIA) shall be responsible for intent and gross negligence within the scope of its liability for culpa in contrahendo.
Subject to a milder standard of liability following statutory provisions (e.g. for care in its affairs), Elli Hoppe (ACRIBIA) shall only be liable in the event of ordinary negligence:

1. for damages resulting from injury to life, body or health and
2. for damages arising from the not inconsiderable breach of an essential contractual obligation (obligation the fulfilment of which is necessary for the proper performance of the contract and the observance of which the contractual partner regularly relies on and may rely on); in this case, however, liability is limited to compensation for the foreseeable, typically occurring damage.
The above limitations of liability shall also apply to third parties as well as to breaches of duty by or for the benefit of persons whose fault Elli Hoppe (ACRIBIA) is responsible for in accordance with statutory provisions.

11) CUSTOMER ACCOUNT & REGISTRATION

To make it easier to use our online shop, you have the option of registering for a customer account.
Your order data is saved in your account or our customer database. This makes it easier for you as a customer to place additional orders and returns.

For registration, we need the following data from you: surname, first name, address, a possibly different delivery address and an email address.
Your email address is automatically your username. You must also create a password for your user account. You can change the username and password at any time after logging into your account.
As a customer, you are responsible for the misuse of the access code and password. The information and personal data that you provide to us will be processed, taking into account and following the applicable data protection declaration.
You can view ACRIBIA‘s data protection declaration at any time in the online shop under “Privacy Policy”. After your registration, you will receive a confirmation message by email that your customer account has been set up for you.
You have the option to delete your customer account at any time or use and place orders the ACRIBIA online shop as a guest.

Please note that we reserve the right to cancel orders, refuse registration and delete the customer account if necessary and inform the responsible authorities if we have reason to believe that the information provided is incorrect or fraudulent orders have been placed by you.

12) DISPUTE RESOLUTION FOR CONSUMERS

The EU Commission has created an Internet platform for the online settlement of disputes. The platform serves as a contact point for out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. Further information is available under the following link: ec.europa.eu/consumers/odr.

However, we (Elli Hoppe, ACRIBIA) are neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

13) FINAL PROVISIONS

These General Terms and Conditions and the contractual relationship with you shall be governed by German law to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
If the customer places an order via our webshop, only the German version of these terms and conditions shall apply.
Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. Instead of the invalid provision, the relevant statutory provisions shall apply.
